Housekeepers, nannies, and caregivers have long been excluded from federal labor laws. They aren’t entitled to overtime pay or a minimum wage. They can’t get workers compensation if they’re injured on the job, or unemployment benefits if they’re fired. Heck, it’s essentially legal for employers to sexually harass them in most states. Greenhouse Agency Ltd. It’s 10 or so years since NYC passed The Domestic/Household Bill of Rights. Essentially, this bill made Domestic Workers Non-Exempt workers. The Department of Labor considers All Workers as non-exempt. From the CEO, to Assistants, to Delivery Drivers, to Cooks, to Nurses and yes Domestic/Household Workers too. All non-exempt workers have the same rights. This includes O/T, minimum wage, Benefits, Vacation, Family Leave and more.
